Replat request on City Council agenda
McCOOK, Neb. — The McCook City Council will be asked to approve a re-platting request from MNB so the bank can build a professional building.
A public hearing on the request is Monday night at the McCook Council meeting, 5:30 p.m. at city council chambers at the City of McCook Municipal Building.
The city received an application from MNB Bank, through its project developer, Engineering International, for the approval of a replat of a portion of Block 1 of Westview Plaza Subdivision. The subdivision is zoned Business Commercial. MNB Bank currently owns the lot in the extreme southeast corner of the Westview Plaza division, where an ATM machine is located. TramLaw Remainderman Limited Partnership and WLM Retail Trust own the property surrounding MNB’s property. MNB Bank wants to purchase a portion of Tramlaw Remainderman Limited partnership’s and WKM Retail Trust’s adjacent property in order to locate a professional building. The combination of the two parcels is necessary to give the bank enough space necessary for the desired building design.
The bank has secured a purchase agreement with the owner of the two properties.
City staff reviewed the application and the proposed replat and has met with a representative of Engineering International to assure the city’s subdivision regulations are followed. After review, city staff has no concerns with the application and support the replat request, with the newly formed Lot 1R that will meet regulations for a business commercial district. Utility concerns were also addressed.
The McCook Planning Commission also reviewed the request at its Sept. 14 meeting and approved it unanimously.
On the regular agenda, the council be asked to approve, under suspension of the three-reading rule, the “Sidewalk Cafe” ordinance to Chapter 120 in the city’s ordinance book. The Sidewalk Cafe ordinance has already been approved by the council but was approved for Chapter 119, the same chapter as “Hotel Companies Occupation Tax” and this new approval will place it under Chapter 120 instead to avoid confusion. The majority of the council must be in favor of suspending the three-reading rule.
After a closed executive session, the council will re-convene in open session and be asked to approve an addendum to the union contract with city firefighters. The contract has already been approved by the council on Sept. 8, but did not include an item that both the city and the union had earlier agreed upon during negotiations in the spring: employee pay for those firefighters who are “on call” during holidays. The addendum the council will be asked to approve will change the pay for on-call employees from 12 hours of pay to 18 hours of pay, the same pay as those employees working the holiday.
Consent agenda items for Monday night, that can be approved in one motion unless pulled for discussion and a separate vote, are:
- Approve the bid specifications for Memorial Auditorium Roof Replacement and set the date to receive bids as Oct.13, 2020 at 2 p.m. City sales tax revenue at $72,000 has been allocated for the auditorium roof replacement. The last time the roof was installed at the auditorium was in1998. For the past several years, temporary repairs have been done in various locations on the roof.
- Adopt Resolution No. 2020-24 setting the property tax request for FY 2020/2021 at a different amount than the property tax request for the prior year. This is the final step of budget and is required if the the property tax request is a different amount than the current year. The McCook City levy for the general fund is the same as last year’s, at $.349044. Current city valuation will generate $1.5 million tax revenue, up from $1.4 million in 2019-20. The city’s maximum levy is $ .45.
- Approve a Memorandum of Understanding with the McCook Area Chamber of Commerce whereby ACE funds will be appropriated for promotional activities that benefit the City of McCook. Last year’s request from the chamber was $2,000.
- Approve the St. Patrick Catholic Church request to close portions of East 4th and East “G” Streets and to utilize city property for their annual Fall Festival on Oct. 10 - 11.
- Adopt Resolution No. 2020-25 which establishes that there is a risk of exposure to COVID-19 through the use of municipal property for Heritage Days purposes and requiring the McCook Chamber of Commerce to enter into the COVID-19 License and Management Agreement for Use of Municipal Property for Heritage Days festivities.
- Approve a Sidewalk Cafe Permit Application from Citta’ Deli that allows for the creation of an outdoor dining area on the sidewalk adjacent to the Citta’ Deli building located at 110 West 1st Street, conditioned upon the execution of a final use agreement between the City of McCook and Citta’ Deli.
-Approve an application from Citta’ Deli, LLC for an addition to their current Class “C” Liquor License issued by the Nebraska Liquor Control Commission, to include an outdoor area owned by the City of McCook to Citta’ Deli’s approved use of the license.
- Approve the application for a Special Designated Liquor License submitted by Loop Brewing Company for a Farm Show at the Red Willow County Fair Grounds Kipling Arena on Nov. 18, 2020, from 10 a.m. - 1 a.m., and Nov.19, from 10 a.m. - 6 p.m.; and shall be subject to comply with any Directed Health Measures in effect at the time of the event.
-Approve an Addendum to the Provision of Services to Senior Citizens Contract FY19-20 and FY20-21 with the West Central Nebraska Area Agency on Aging (ie. WCNAAA)
- Ratify the Mayor’s appointment of Jeremy LaBrie to replace Bill Larington to the Parks Advisory Board, term expires May 2022.
