More jail time handed down on weapons charge
McCOOK, Neb. -- A local felon sentenced to jail time earlier this year for attempted possession of a deadly weapon was sent back to jail earlier this week in Red Willow County District Court on a Class 3 felony conviction for possession of a deadly weapon by a prohibited person.
The offender, 34-year-old Daryl J. Banzet of 209 East 2nd Street, was sentenced to 180 days in jail Monday, in addition to nine months post release supervision. He was also given credit for 113 days already served.
According to court documents, Banzet was arrested and subsequently charged with the Class 3 felony after a law enforcement officer noticed a knife sheath attached to his hip and holding a knife longer than the three-and-a-half inches allowed for convicted felons. The officer subsequently confiscated two knives from Banzet, both with blades approximately 4 inches in length.
The officer was also aware Banzet had been arrested in 2015 for possession of a deadly weapon stemming from a knife.
Banzet accepted a plea agreement in January stemming from the 2015 arrest and was subsequently sentenced to jail time in March on a Class IV felony offense for attempted possession of a deadly weapon by a convicted felon. He was sentenced to 90 days in jail and given credit for 103 days already served.
The 2015 charge stemmed from a disturbance report of someone banging on air conditioners at an apartment complex at 902 East E Street. Banzet told responding officers he had been kicked out of his apartment and was subsequently arrested after a knife was found in his possession and it was discovered he was a convicted felon.
