Plea reached in drug, weapon, sex offender violation case
McCOOK, Neb. -- A plea agreement was reached with a McCook man earlier this week in Red Willow County District Court admitting guilt to felony possession of methamphetamine and an attempted sex offender registration violation.
The man, 34-year-old Jeffery G. Waggener of 709 W. Second Street, formerly of Oberlin, Kansas, was subsequently scheduled for sentencing at 9 a.m. on July 11, 2016.
Waggener's plea agreement pleaded no contest to a Class IV felony for possession of meth and a Class I misdemeanor for attempting to violate the sex offender registry. He was originally facing a Class IV felony alleging possession of methamphetamine; a Class 3 felony alleging possession of a deadly weapon by a convicted felon; and an infraction alleging possession of marijuana; in addition to an unrelated criminal case charging him with a Class 3A felony for sex offender registration violations.
The plea agreement reduced the sex offender violations while dismissing the weapon and marijuana charges. The weapon charge stemmed from a knife and brass or iron knuckles, and the registration violations stem from his failure to report an address change and a change of employment, according to court documents.
In Nebraska, Class IV felonies carry a maximum sentence of two years imprisonment, 12 months post-release supervision and a $10,000 fine, with no minimum sentence.
Other activity in Red Willow County District Court, April 4, 2016:
* A McCook woman pleaded not guilty to a felony drug charge and other violations. The case against the woman, 39-year-old Wendy D. Ulmer of 1203 West 13th Street, was subsequently continued until May 9, 2016.
Ulmer is facing a Class IV felony alleging possession of methamphetamine; an infraction alleging possession of drug paraphernalia; and an infraction alleging she failed to signal a turn.
* A criminal case against an Ogallala man, who pleaded not guilty to felony assault of an officer earlier this year, was scheduled for a status hearing at 9 a.m. on July 11, 2016. The man, 56-year-old Lawrence A. Bryant, is facing a Class 3A felony alleging 3rd-degree assault of an officer.
