Jail time sentence for drunk driving
McCOOK, Neb. -- A McCook man was sentenced to jail time last week following his conviction on a second offense drunk driving charge.
The offender, 24-year-old Chance D. Evans of 307 E. Fifth Street Apt. 4, was originally facing a charge for DUI (.15+) third offense. He accepted a plea agreement in September admitting guilt to a lesser DUI (.15+) second offense.
Evans was subsequently sentenced on Nov. 2 in Red Willow County District Court to serve 30 days in jail, pay a $1,000 fine and serve 24 months on probation. His driver's license was also revoked for 18 months and he was given credit at sentencing for 19 days in jail already served.
Evans was previously convicted of drunk driving in Red Willow County in August of 2012 and again in Hitchcock County in August of 2013.
Evans conviction last week stems from his arrest by the Nebraska State Patrol in January following a 2:36 a.m. traffic stop on County Drive 716. He was originally cited with additional offenses for driving left of center and not wearing a seatbelt, neither of which were pursued by the prosecution.
Other activity in Red Willow County District Court, Nov. 2, 2015:
* Sentencing for a Cambridge woman on misdemeanor drug offenses was continued to a later date. The offender, 26-year-old Cherri M. Kershaw, accepted a plea agreement in August admitting guilt to a Class I misdemeanor offense for attempted possession of alprazolam and infractions for possession of marijuana and drug paraphernalia. She was originally facing a Class 4 felony alleging possession of alprazolam and a misdemeanor offense alleging she was operating a vehicle without insurance.
Kershaw is scheduled for sentencing at 10 a.m. on Dec. 9, 2015.
* A McCook man pleaded not guilty to a Class 4 felony charge alleging possession of methamphetamine. The case against the man, 41-year-old Joshua J. O'Neil of 703 E. Fifth Street, was scheduled for a status hearing at 3:45 p.m. on Dec. 9, 2015.
* An Indianola woman pleaded not guilty to a felony charge alleging possession of methamphetamine and an infraction alleging possession of drug paraphernalia. The case against the woman, 54-year-old Candance Reed, was subsequently scheduled for a bench trial at 1 p.m. on Nov. 24, 2015.
* A motions hearing was continued until Feb. 1, 2016, at 9:15 a.m., in a felony drug case filed against a McCook woman. The woman, 52-year-old Judith Stark of 711 East H Street, pleaded not guilty to a felony charge alleging possession of methamphetamine and an infraction alleging possession of drug paraphernalia in October.
* A status hearing was continued until Dec. 9, 2015, at 3:05 p.m., in a felony drug case filed against 53-year-old Patricia A. Stark of 708 E. Fifth Street. Stark pleaded not guilty to a Class 4 felony charge alleging possession of methamphetamine and an infraction alleging possession of drug paraphernalia in October.
