New city attorney from city manager's firm

McCOOK, Neb. -- The City of McCook is looking to fill its vacant City Attorney position with an employee from the legal firm City Manager Nate Schneider is a partner in.

City Council will consider approving Nathaniel J. Mustion as McCook's next city attorney Monday evening. Mustion is an employee of Mousel, Brooks, Garner and Schneider, P.C., LLO. Schneider is a one-third member of the law firm as well as with Law 101, LLC, which owns the building the attorney practice operates out of.

According to Monday's agenda, the city attorney contract is not subject to City Council approval, however, given Schneider's relationship with the firm city staff believed it to be important to disclose. "This agreement will not serve to profit Mr. Schneider, as the expenses of Mr. Schneider are paid by him individually," according to the agenda.

Mustion is slated to receive a $2,200 monthly retainer, $125 per hour non-retainer fee, a Westlaw subscription with McQuillan Municipal Corporation program included and enrollment for one League of Municipalities meeting.

The agenda information does not state whether the amounts or compensation differ from previous City Attorney contracts.
