Man pleads no contest to reduced charge of sexual assault

MULLEN, Nebraska -- In Hooker County, Nebraska, district court Dec. 19, a McCook man pleaded no contest to a charge reduced from felony sexual assault of a minor, a 6-year-old relative whose family lives in Mullen.

George Vinton, Hooker County attorney, said this morning that Timothy Robert McCarville, 55, of 1301 Missouri Avenue, McCook, was found guilty by the Hooker County judge of a reduced charge of third degree sexual assault (with no bodily injury), a Class 1 felony.

Vinton said the allegation involved touching through clothing and that the little girl, a relative of McCarville, was not injured.

McCarville was to have been in court Jan. 4, but agreed to a plea arrangement Dec. 19.

McCarville was sentenced to 77 days in jail and was given credit for 46 days served and for good time. McCarville is not currently in jail, Vinton said.

McCarville was ordered to register as a sex offender with the Nebraska State Patrol Sex Offender Registry, which describes McCarville as 5'10" tall, weighing 223 pounds, with brown hair and eyes.

The registry indicates that McCarville was convicted of third degree sexual assault, and that the victim of the crime is a minor.
