A McCook City councilman faces a felony charge in District Court in connection with the alleged theft of oil equipment.
James P. Kenny, 49, of 310 Park Ave., has been accused of theft by unlawful taking, a Class IV felony. No date has been set in Red Willow County District Court.
Kenny allegedly took an oil well pumping unit, valued at $500 from Kathy Hesterwerth, doing business as Hesterwerth Oil, on June 3.
Red Willow County Attorney Paul Wood has removed himself from the case, citing a conflict of interest. Pete S. Burger has been appointed as special prosecutor for the state.
Kenny has retained attorney R. Kevin O'Donnell of Ogallala.
