Indianola man sentenced in death of man at scene of crash that killed his brother

McCOOK, Neb. — In Red Willow County District Court on Monday, an Indianola man was sentenced to prison in connection with the killing of another man at the scene of a car crash that killed his brother.

Alva C. Decker, 35, pleaded no contest to a Class 1 felony charge of manslaughter, amended from first-degree murder under a plea agreement, and was sentenced by Judge Patrick M. Heng to 20 years in jail with credit for 921 days served. He also pleaded no contest to tampering with evidence, a Class 2 felony, amended under a plea agreement from conspiracy to commit a Class 1 felony, and was sentenced to 15 to 20 years in jail. Both sentences were to start immediately. A charge of use of a firearm to commit a felony was dismissed.

The charges are in connection with an incident at about 2 a.m. Oct. 8, 2020, in which Decker’s brother, Charles Edward Decker, 36, Indianola, was killed in a motor-vehicle collision on U.S. 6-34 west of Indianola, and Steven Lee Weaver, 30, McCook, was also found dead at the scene.

Court documents indicated Charles Decker allegedly tried to ram Weaver off the road, causing both vehicles to crash. Decker was ejected the killed and Weaver was found dead with gunshot wounds.

In a related case, last May, Travis Terwilliger, 49, of McCook was sentenced to three years in prison and 18 months post-release supervision on one count of terroristic threats and two years in prison and one year of post-release supervision for one count of accessory to a felony.

  • Only 20 years for murder? Hopefully his sentences are consecutive and not coinciding. This is exactly why we have a gun problem in this country. Offenders are able to plead down to lessor charges and have shorter sentences. What a useless piece of oxygen
