Church burglar to jail on probation violation
McCOOK, Neb. — A North Platte man sentenced to probation last fall on criminal mischief and theft charges was back in Red Willow County District Court recently facing probation violations. The man, 20-year-old Maxwell J. Allen, was sentenced to 180 days in jail after his probation was revoked for testing positive for cocaine and marijuana use, as well as failing to report.
Allen was originally sentenced to 24 months probation last November stemming from his arrest following the burglary of the Congregational Church on East E Street in McCook. He was originally facing a Class 2A felony alleging he burglarized the church in October of 2015 and accepted a plea agreement admitting guilt to a trio of misdemeanor offenses, including a Class I misdemeanor for criminal trespassing; a Class 2 misdemeanor for theft by unlawfully taking property valued at less than $500; and a Class 3 misdemeanor for criminal mischief which caused damage to property valued at less than $500.
Allen’s probation was subsequently revoked during a Sept. 11, 2017, hearing and he was ordered to serve 180 days in jail, in addition to a concurrent 90 and 30 days in jail. He was given credit at sentencing for 36 days already served.
According to court documents, Allen’s probation violations stem from his failure to report to his probation officer on Dec. 20, 2016; three times in January of 2017; once in February and twice in March of 2017. He also tested positive for marijuana use in November of 2016, as well as for cocaine use in February and again in March of 2017.
Allen refused to submit to a chemical test on April 4, 2017, and failed to report for drug testing once in February, twice in March and again on April 3, 2017.
