Probation ordered on meth, child abuse charges
McCOOK, Neb. -- A McCook woman was fined and ordered to serve probation on illegal drug and child abuse offenses Monday in Red Willow County District Court.
The offender, 25-year-old Courtnie Clements of 1405 West 16th Street, was sentenced to 30 months probation and ordered to pay $400 in fines after being convicted of felony possession of methamphet- amine and misdemeanor child abuse.
Clements accepted a plea agreement in June dismissing a Class IV felony offense alleging possession of alprazolam, while admitting guilt to a Class I misdemeanor offense for committing child abuse negligently, without injury, a Class IV felony offense for possession of methamphetamine and infractions for possession of marijuana and drug paraphernalia.
Clements was arrested in March, along with David Clements and Derek Rouse, following a report of someone snorting a white powdery substance near the military tank at Barnett Park in McCook. Courtnie Clements 2-year-old daughter was taken into the care of the Nebraska Department of Health and Human Services at the time of the arrests.
Other activity in Red Willow County District Court, Aug. 3, 2015:
* 19-year-old Javier A. Casarez of 707 East C Street pleaded not guilty to a Class IV felony offense alleging possession of methamphetamine. Casarez was subsequently scheduled for a motions/status hearing at 10:15 a.m. on Sept. 14, 2015.
A trial was also coordinated Monday as part of an unrelated criminal case filed against Casarez and pursuing several probation violation allegations. Following the trial Casarez was scheduled for sentencing on the violations at 10:15 a.m. on Sept. 14, 2015.
The probation violations stem from Casarez arrest on a criminal trespass offense in February and again in May on a forgery charge, as well as other violations. Casarez was originally sentenced to 36 months probation in January on a Class IV felony offense for being an accessory to a felony and two misdemeanor offenses for receiving stolen property and theft by unlawful taking.
* 34-year-old Jeremy D. Nickerson of Trenton, Nebraska, pleaded not guilty to a pair of felony charges, and several other alleged offenses, and was subsequently scheduled for a status hearing at 10:45 a.m. on Sept. 14, 2015. Nickerson is facing a Class 3 felony alleging fourth offense drunk driving; a Class 4 felony alleging he drove on a driver's license already revoked for drunk driving; three misdemeanor offenses alleging he operated a motor vehicle to avoid arrest, refused a preliminary breath test and refused a chemical test; and an infraction for possessing an open alcohol container.
* A sentencing hearing for 38-year-old Luke Warburton of Culbertson was continued until 1:15 p.m. on Oct. 5, 2015. Warburton accepted a plea agreement in May admitting guilt to a Class IV felony offense for theft by unlawful taking and a Class I misdemeanor offense for attempted possession of methamphetamine. The charges stem from the theft of a 1998 Chevy pickup in April and subsequent break-in at the former Republic River Valley School building between McCook and Indianola. The stolen vehicle, owned by Darren and Tyler Esch, was recovered in the parking lot of the school building and investigating officers arrested Warburton inside during a search of the building.
* 36-year-old Michelle Williams of Elwood, Nebraska, pleaded not guilty to a Class IV felony offense alleging possession of methamphetamine. Williams was subsequently scheduled for a motions hearing at 2:30 p.m. on Oct. 5, 2015.
