Jury trial scheduled in burglaries
McCOOK, Nebraska -- A jury trial is set for April 14 in a case against a North Platte man charged with 30 felonies related to an extensive list of local burglaries. The accused, 38-year-old Timothy D. McMains, posted the required 10 percent of his $150,000 bond in October.
McMains was ordered not to leave the state of Nebraska, although he was not required to stay in Red Willow County, according to court documents.
The trial, set at a hearing last week, will begin at 9 a.m. April 14 in Red Willow County District Court.
McMains is a former McCook resident and accused of burglarizing a total of nine local businesses and one in Bartley, as well as three churches, three non-profit organizations and six governmental offices, several of them broken into multiple times. He was also charged with stealing three vehicles and interfering with the apprehension of another man accused of burglary.
The crimes date as far back as October 2010 and as recent as April 2013.
The charges against McMains combine for 21 Class III felony counts of burglary; five Class IV felony counts of attempting a Class III felony; three Class III felony counts of theft by unlawful taking; and one Class IV felony count of accessory to a felony.
Four other men have been charged, or already sentenced, in connection with the crimes. McMains is charged with a significantly higher number of offenses than the other men.
The only one sentenced so far, 21-year-old Michael A. Templeman of 1102 West 13th Street, was sentenced to 30 months probation and ordered to pay $842 in restitution. Templeman pleaded no contest to a pair of Class III felony burglary offenses and was subsequently sentenced to probation and ordered to pay $342 in restitution to Rowe's Repair and $500 in restitution to the City of McCook.
Michael Sanders, 37, of 902 East E Street Apt. A, accepted a plea agreement dismissing several charges while still admitting guilt to six felonies and one misdemeanor. Sanders is scheduled for sentencing at 10 a.m. on Dec. 2, in Red Willow County District Court.
Adam Rawn has been charged in connection with at least one of the burglaries. Rawn is scheduled for arraignment at 9:15 a.m. Jan. 13 and is facing one offense of Class III felony burglary.
Jeffrey Phelps has been identified as the fifth man accused of having been involved in the crimes.
Phelps was arrested on burglary charges in North Carolina and returned to Nebraska, according to the McCook Police Department. His preliminary hearing is scheduled in Red Willow County Court at 11:30 a.m. Thursday, Nov. 21.
The charges against the men stem from burglaries at the City of McCook Transfer Station; SWATS workshop; Republican River Valley Events Center; First Assembly of God Church; The Bottle Shop; Rowe's Repair; Western Tire; City of McCook Senior Center; Ed Thomas YMCA; Red Willow County Fairgrounds; two attempted burglaries in Red Willow County; two burglaries in Hitchcock County, including the burglary and theft of an ATM machine from the K Store in Culbertson, Nebraska; an attempted felony theft of an ATM machine in Furnas County; as well as three stolen motor vehicles and the theft of a firearm.
McMains' booking photo was released by the McCook Police Department early in the investigation as part of an effort to enlist the public's help in apprehending the suspects.
